Extract of:  America's Injustice System Is Criminal

According to the International Center for Prison Studies at King's College in London, the US has 700,000 more of its citizens incarcerated than China, a country with a population four to five times larger than that of the US, and 1,330,000 more people in prison than crime-ridden Russia. The US has 5% of the world's population and 25% of the world's prisoners. The American incarceration rate is seven times higher than that of European countries. Either America is the land of criminals, or something is seriously wrong with the criminal justice (sic) system in "the land of the free."

In the US the wrongful conviction rate is extremely high. One reason is that hardly any of the convicted have had a jury trial. No peers have heard the evidence against them and found them guilty. In the US criminal justice (sic) system, more than 95% of all felony cases are settled with a plea bargain.

Before jumping to the conclusion that an innocent person would not admit guilt, be aware of how the process works. Any defendant who stands trial faces more severe penalties if found guilty than if he agrees to a plea bargain. Prosecutors don't like trials because they are time consuming and a lot of work. To discourage trials, prosecutors offer defendants reduced charges and lighter sentences than would result from a jury conviction. In the event a defendant insists upon his innocence, prosecutors pile on charges until the defendant's lawyer and family convince the defendant that a jury is likely to give the prosecutor a conviction on at least one of the many charges and that the penalty will be greater than a negotiated plea.

Sep 25, 2010 Jeremiah Bradford died. He was the son of Gerald Bradford and Patricia Cage.

At the time of Jeremiah’s death Cage had a live in Boy Friend (Sean Starwalt) who worked and supported Cage financially. Cage had not worked for about a year, since the death of Jeremiah’s Father.

After the death of Baby, on Sep 27, 2010 Cage was initially charged only with child endangerment, while her live in boy friend was charged with First Degree Murder. The difference in the charges was questioned!

April 28, 2011 (7 months later) Cage the mother was also charged with  First Degree Murder of her son (the same charges her live in Boy friend was charged with).

The State’s Attorney’s Office has requested that Starwalt receive an extended sentence in his 1 count charge of 1st degree murder.  This would raise his sentence from 48 years to 100 years in prison if found guilty.

Considering equal justice, why hasn’t the state request an extended sentence for Cage’s (the mother of Jeremiah) 2 counts; which are Child Endangerment and First Degree Murder of her son?

Nearly a year passed and Sean continued to plead his innocence. That is until he was informed by his lawyer of the request for an extended sentence.

He has submitted a Pro se motion to the court to withdraw his guilty plea, he has not heard from his Attorney or the Judge on the motion. He strongly believes that he will be found innocent if witnesses and evidence will be presented for his defense!

To the Editor:

In the telegraph article of Friday September 16, 2011 the state incorrectly stated that “Prosecutors said testimony would have shown that the death blows were inflicted the night before when Cage left the victim in Starwalt’s care while she went to the store.”
On Thursday November 17, 2011 during the sentencing hearing of Sean Starwalt the expert witness Pathologist Dr. Raj Nanduri when asked if she could state when the death blows were inflicted to Jeremiah Bradford her answer was NO!
Dr. Nanduri was asked was she able to state who committed the death blows to Jeremiah, and again her answer was NO!
The State should have known that it could not be proven what time the blows were made, but wanted to make it appear that Starwalt committed the crime in spite of what the evidence indicated. Anyone that would do online inquiries would be able to find out in a very short period of time that what was stated by the State was not true!  It was a lie, a mistake or possibly a typographical error!
On September 27, 2010 Cage, Jeremiah’s mother was charged with child endangerment, and Starwalt was charged with First Degree Murder.

Cage’s child endangerment charge should have had the element of Accountability placed with it, instead of placing Accountability in the first degree murder charge. The reason being, at that time the state did not believe that Cage was guilty of killing her son Jeremiah. The state’s charge of first degree murder against her son on April 28, 2011 indicates that they believe now that she killed her son. The charge of first degree murder on Cage was filed stating she killed her son! The way the state charges against Cage were written, reported, discussed and printed unfairly prejudiced Starwalt’s case, and does not reflect the truth.

Madison County State's Attorney Thomas Gibbons said additional evidence supports a first-degree murder charge against Cage based on her alleged failure to protect the child from Starwalt and failure to seek immediate medical attention.
Mr. Gibbon’s statement does not reflect the truth that is contained in Cage’s First Degree Murder Charges!
Cage’s First Degree Murder Charges states that she struck the blows that caused Jeremiah’s Death!

   The body of the first degree murder charge against Cage does not indicate that the charge had anything to do with accountability. 
On September 25, 2010 Patricia Cage and Sean Starwalt ended up at the emergency room at Alton Memorial Hospital with Jeremiah. Several friends and family members also came to the hospital to check on the welfare of Jeremiah. While at Memorial Hospital in Alton several people noticed scratches on Cage’s arm and bruises on her hand. In addition Cage had a missing or loose tooth. Two of the people who saw the scratches and the bruises and or the missing or loose tooth felt pressure from relatives not to come forward, and report the scratches to the police. There are signed written statements to support seeing Cage’s injuries. Public defender Attorney Berkley choose not to use those written statements to support Starwalt’s innocence. Mr. Berkley is no longer defending Starwalt.

The Roxana Police investigators failed to take pictures of Cage’s and Starwalt’s hands and arms, that does not appear to be a mistake by most people.  Starwalt did not have scratches on his arms, bruises on his hands, or any physical indications on his body that he harmed Jeremiah. or that Jeremiah scratched him. Starwalt asked to have Jeremiah’s body exhumed for DNA testing, it did not happen, no motion was filed by his Attorney.

Starwalt’s Attorney Tim Berkley was aware of allegations about the scratches but did not feel it was relevant in the case. So he refused to put witnesses on Starwalt’s witness list who could have testified about the scratches, including a nurse at St. Anthony’s Hospital in Alton. Mr. Berkley did not enter the statements about the injuries to Cage as discovery in the case.
Mr. Berkley apparently did not subpoena the information from the hospital that would confirm if she had drugs in her system, and if she had scratches on her arms, and if she suffered from depression. He refused to obtain witnesses to support Starwalt. Mr. Berkley has been removed from Starwalt’s case.

January 4, 2012 at 9 AM there was a hearing in the Circuit Court in Edwardsville which was scheduled to consider a Pro se motion from Sean Starwalt to withdraw his guilty plea in the Murder of Jeremiah Bradford. Because Sean Starwalt filed an Amended Pro se Motion on January 3, 2012 to withdraw his guilty plea Judge Hackett took the following action; 1. Judge Hackett removed Attorney Scott Turner from Starwalt’s case with Turner’s approval. 2. Offered Starwalt the opportunity to defend himself, which he decided not to do. 3. Stated that he would began the process to locate another Public Defender for Stawalt.
